T-mobile USA Outage

For those who missed it earlier (and it's going on about 5 or 6 hours since
the first notice, I think), T-Mobile (a division of Deutsche Telekom), had a
generalized outage of most cellular voice and SMS service, though -- some
reports said -- not data/mobile web, which they've started to recover from,
but they're not at full operation yet.

Curious what part if any in the T&Cs does this make a breach of
agreement for service. Or sai another way t-mobile was not meeting
industry standards.
